Disasters can strike at anytime anywhere, will you and your family be ready? You should be aware of the risks in your area. Ask yourself do I live in a flood zone area, is my area known for hurricanes, earthquakes, hail storms, Tsunamis, wildfires, volcanoes, and tornadoes. If so you should plan according to the risk in your area.

Plan in advance where to meet if your family members are separated, like kids being in school, parents at work etc. Also have a certain person in which everyone will call to let them know where they are.

Prepare in advance an emergency supply kit. Figure out how much food and water your family will need for about 4 days. Today there is a variety of food storage containers that you can buy to use in your emergency kit. You can choose from freeze-dried fruits like strawberries, blueberries, peaches, bell peppers, cheese, meats for breakfast, lunch or dinner. Some of the freeze-dried meals are fettuccine alfredo with or without chicken, beef stroganoff, beef stew, lasagna with meat sauce, chicken teriyaki with rice. Than there are dehydrated eggs, butter, tomatoes powder, low-fat granola. After you have everything you need put all your supplies into a large container with handles so that it will be easier to carry, but don’t make it to heavy.

A food storage container can also be used for your flashlight, batteries, radio, first-aid kit, matches, lighters, blankets, extra clothes, shoes, towels, paper plates, paper towels, wipes, plastic spoons, forks, knifes, tooth brush and paste, toilet paper and extra money. Also make copies of your insurance policies, mortgage papers, car information, family pictures, photo albums anything important to you and than burn them on a CD and place it into your container, or just keep the paper copies and put them into the container. Keep an up to date utility bill in the container to show proof that you were living there at the time of the diaster. Put your containers in a place that you can get to quickly.

If you live in a hurricane area the season runs between June and November in the United States. Most hurricanes are usually slow travelers so this will give you time to decide if you are going to stay or leave. If you are going to leave put your containers in the car early so that you will not leave anything. Leave early so that you will not get caught up in the traffic.

Tornado season is usually between April and July but sometimes it may come earlier. Those who have basements, or storm shelters should go there when they hear the sirens. Another safe place will be a room with no windows. If you live in a trailer home you should find other shelter and prepare to take your emergency kit with you.

The first step to understanding the process of obtaining a family law domestic violence restraining order is to understand that this process is quite different from the process involved when protective orders are automatically put into place by the courts in criminal matters. In criminal matters, the police and the court are empowered to issue automatic temporary restraining orders. Evidentiary hearings are not conducted before these restraining orders are put into place. Consequently, in criminal courts the protected party does not need to be a part of the process.

In many instances, victims of domestic violence need to obtain a restraining order in family court, for example, where the criminal court restraining order is not adequate to deal with issues such as child support, spousal support, or custody and visitation. In other instances, a victim of domestic violence may need the protection of the family court where criminal charges were not filed or have been dismissed.

Unlike criminal matters, the protected party seeking a family law restraining order has to file his or her own papers, attend at least two hearings, and be able to conduct an evidentiary hearing. In addition, the Petitioner in a family court restraining order matter is responsible for ensuring that the Respondent has been served prior to the hearing.

At the hearing, Petitioners seeking a family law restraining order must be able to present a case, and convince the judge by a preponderance of the evidence that domestic violence was committed. Thus, a basic understanding of what constitutes domestic violence is essential. In some instances, the matter does not qualify as a domestic violence case, because the parties do not have the right type of relationship. Instead, the case may be filed as a Civil Harassment matter, which involves its own unique process and standard of proof.

The hearing for a permanent restraining order is essentially a mini trial. At the hearing, all of the rules of evidence apply, and both parties have the right to a meaningful opportunity to present evidence and cross examine witnesses. Preparing for a family court restraining order hearing should include, composing direct and cross examination questions, and when possible, gathering of physical and demonstrative evidence. In this high tech age that we live in, e-mail messages, voice messages, and surveillance video are frequently introduced into evidence to prove or disprove a case. Police reports are also allowed into evidence as an exception to the hearsay rule. Thus, litigants should attempt to obtain police reports, whenever possible, as they can be very persuasive to the judge. People within the legal profession recognize the serious consequences involved with the issuance of permanent restraining orders. Given that restraining orders typically impose significant limitations on a partys liberty, and can affect a partys ability to find or maintain employment, these matters are being taken more seriously by the courts in recent years. Courts have become more skeptical of the requests that are made for restraining orders and hold the moving party to his or her burden. Indeed, the days of family courts rubber stamping restraining orders appear to be coming to an end. Consequently, it is incumbent upon any person who is faced with having to be a part of this process to do his or her homework before entering the courtroom.

Family And Doctors Reach Settlement For Death Of Forty Six Year Old Woman

Though a colonoscopy is normally recommended as a screening tool for colorectal cancer for individuals who are fifty years old and older, doctors usually recognize that reports of rectal bleeding by a patient merit performing a colonoscopy even if the patient is younger than fifty. Regardless of whether a colonoscopy or a sigmoidoscopy is performed, though, if the examination is not complete and adequate visualization was not achieved, doctors normally recommendedthat the procedure should be done again. While the sigmoidoscopy only permits examination of a limited section of the colon, the doctor documented that the sigmoidoscopy was not finished and that it had not been possible to examine the full length even of the sigmoid. Despite the poor visualization, the gastroenterologist failed to suggest that the procedure be repeated so as to properly examine the sigmoid.

The woman saw her physician for 2 yearly physicals after that and each time told him that she kept experiencing problems with constipation. At one point the physician spoke with the patient’s daughter and although he told her he would give some thought to a colonoscopy at some point in the future he proposed that the patient was suffering from irritable bowel syndrome and simply should eat more fiber. Later on he told the patient to begin taking lactulose. Ultimately, when a physical examination showed abdominal tenderness and a structure suspicious for stool in the colon, the physician ordered a check of her thyroid and at last referred her for a colonoscopy.

Roughly two weeks later, the woman ended up in the emergency room when she experience pain and vomiting while prepping for a colonoscopy. The emergency room physician found that she had a distended abdomen and could hear hyperactive bowel sounds. in addition, the woman had abdominal tenderness, mostly on the lower left. Given these symptoms the hospital physician had her get. The scan found a mass in the sigmoid with metastasis. Two weeks later the patient underwent surgery to take out the 4.2 cm mass. The surgeon found that her cancer had spread throughout a variety of organs. She began chemotherapy for stage 4 colorectal cancer. She died a little over four months following her surgery.

The womans family initiated a lawsuit against the family doctor and gastroenterologist. The law firm that represented the family was able to resolve the case with a settlement in the amount of $2.0 million.
